Effective Date: 08-01-2026
Company: Arta, doing business as Cheap Joe’s QR codes (“Company,” “we,” “us,” or “our”)
Website/Service: https://cheapjoesqr.com and related pages, plugins, and services that generate static and dynamic QR codes (the “Service”).
By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
The Service
We generate QR codes based on information you submit. “Static” codes are fixed at creation. “Dynamic” codes may redirect through our infrastructure and can include analytics/events logging and destination updates (if enabled). Delivery is typically via email to the address you provide.
We may improve, modify, suspend, or discontinue any part of the Service at any time with or without notice.
Your Account & Security
You are responsible for your account, devices, and the confidentiality of your credentials. We are not responsible for any loss or damage arising from unauthorized access to your account caused by your failure to safeguard credentials (e.g., weak/reused passwords, phishing, compromised email/device)—sometimes called “lost password hacks.” Use a strong, unique password (and 2FA if available) and keep your contact details current.
Payment
Payments are processed via WooCommerce using third-party processors such as Stripe, PayPal, and Apple Pay. Those providers process your card data under their own terms and privacy policies. We receive limited transaction details (e.g., status, ID) to fulfill your order. Prices, taxes, and fees are shown at checkout and are subject to change until the order is placed.
Your Content & License
You retain ownership of the content you encode. You grant us a worldwide, non-exclusive, royalty-free license to host, reproduce, transmit, display, and otherwise process your content solely to provide the Service (including email delivery, dynamic redirects, previews, backups, and troubleshooting).
You represent and warrant that you have all rights necessary to submit the content and that it does not violate law, third-party rights, or these Terms.
Acceptable Use (No Sensitive/Illegal Content)
You agree not to use the Service to:
- Encode or transmit payment card numbers, bank account numbers, government IDs, passwords/credentials, authentication secrets, or protected health information;
- Distribute malware, phishing, spyware, illegal content, or content that is defamatory, infringing, abusive, or deceptive;
- Violate any law or regulation, including privacy, IP, export, and consumer-protection laws;
- Interfere with or disrupt the Service or attempt to bypass security.
We may block, remove, disable, or suspend any content or code that we reasonably believe violates these Terms or creates risk.
Dynamic QR codes & Redirects
Dynamic codes may rely on our redirect infrastructure and third-party networks. Availability can be affected by internet or platform outages, DNS/hosting providers, or destination-site failures. We do not control your destination URL or third-party sites and are not responsible for their content, uptime, or behavior. We may implement fair-use limits (e.g., unusually high scan volumes or abusive traffic) to protect the Service.
Delivery Email Considerations
We generally deliver QR codes via email. Email is not end-to-end encrypted; avoid encoding secrets that could be exposed if an email is forwarded or an inbox is compromised. Check spam/junk folders and ensure your mailbox can receive attachments.
Refunds,Corrections, and Cancellations
See the Refund & Returns Policy below, which is incorporated into these Terms.
Privacy
Our Privacy Policy explains how we collect, use, and protect personal information and forms part of these Terms.
Intellectual Property
The Service (including software, workflows, templates, and branding) is owned by us or our licensors and is protected by IP laws. Except for the limited rights expressly granted, no license is implied.
Disclaimers
THE SERVICE (INCLUDING QR CODES, REDIRECTS, ANALYTICS, AND EMAIL DELIVERY) IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, QUIET ENJOYMENT, AND NON-INFRINGEMENT.
We do not warrant that codes will be scannable by every app/device, that redirects will be uninterrupted or error-free, or that destination websites will be safe/available.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOSS OF PROFITS, REVENUE, GOODWILL, OR DATA; OR COST OF SUBSTITUTE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY.
OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNTS YOU PAID TO US FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY OR USD $100, WHICHEVER IS LESS. Some jurisdictions do not allow certain limitations; in such cases, the above caps apply to the fullest extent permitted.
Indemnification
You will defend, indemnify, and hold harmless the Company and its affiliates, officers, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your content, codes, or destinations; (b) your breach of these Terms; or (c) your violation of law or third-party rights.
Suspension/Termination
We may suspend or terminate access to the Service (including specific codes) if we reasonably believe you violated these Terms, present a security or legal risk, or fail to pay amounts due. You may stop using the Service at any time.
Changes to the service/Terms
We may update the Service and these Terms. Material changes will be posted on the Website or sent to your account email. Continued use after changes constitutes acceptance.
Governing Law; Dispute Resolution
These Terms are governed by the laws of the State of California, without regard to conflict-of-laws rules.
Binding Arbitration & Class-Action Waiver. Any dispute arising out of or relating to these Terms or the Service will be resolved by final, binding arbitration administered by JAMS under its Streamlined Rules. The seat of arbitration will be San Francisco County, California, and proceedings may be conducted by video/teleconference. You and we waive any right to a jury trial and to participate in a class or representative action. Notwithstanding the foregoing, either party may seek injunctive relief in court to protect IP or prevent unauthorized access/misuse.
Severabilit; Assignment; Entire Agreement
If any provision is unenforceable, the remainder remains in effect. You may not assign these Terms without our prior written consent; we may assign to an affiliate or in connection with a merger, acquisition, or asset sale. These Terms (plus policies referenced herein) are the entire agreement between you and us regarding the Service.
